Texas family law matters we handle
Our practice covers conservatorship (what many parents call custody), possession and access schedules, child support, spousal maintenance, modifications of existing orders, and enforcement when the other parent does not follow the order.
Under the Texas Family Code, courts decide conservatorship based on the best interest of the child. Texas law presumes that parents should be named joint managing conservators in most cases, but that presumption can be rebutted by evidence — which is why documentation and preparation matter.
How a family case moves through the courts
A suit affecting the parent-child relationship or a divorce petition is filed with the district clerk in the county where venue is proper. Temporary orders often follow within weeks and set the ground rules while the case is pending. Many cases resolve at mediation; those that do not are set for final hearing or trial.
Texas requires a 60-day waiting period between filing an original petition for divorce and the earliest date a court may grant it, with limited statutory exceptions.
