Learn: Texas Family Law

Texas family law is governed by the Texas Family Code. Courts decide conservatorship, possession and access, child support, and property division using the best-interest standard.

Texas authorities

  • Texas Family Code Ch. 153 — Conservatorship, Possession, and Access
  • Texas Family Code Ch. 154 — Child Support
  • Texas Family Code Ch. 156 — Modification of Orders
  • Texas Family Code Ch. 157 — Enforcement

How Texas decides custody (conservatorship)

Texas statutes use conservatorship and possession and access rather than custody. Chapter 153 creates a rebuttable presumption that joint managing conservatorship is in the child's best interest.

Child support under Chapter 154

Guideline child support is a percentage of the obligor's net monthly resources, subject to a statutory cap, with medical and dental support ordered in addition.

Modifying and enforcing orders

Chapter 156 allows modification on a material and substantial change in circumstances; Chapter 157 governs enforcement, including contempt.
